Introduction

Welcome to www.yachtcharterindonesia.com. This website is one of many sites managed by us and is part of our portfolio of marketing tools we offer to promote yacht charters. It offers users the ability to be informed about chartering a yacht (in Indonesia) and through facilitation make a direct reservation/booking with the yacht. These terms and conditions govern your use of our website and the services we provide. By using our website or our services, you agree to be bound by these terms and conditions.

These terms and conditions (“Agreement”) set forth the general terms and conditions of your use of the www.yachtcharterindonesia.com website (“Website” or “Service”) and any of its related products and services (collectively, “Services”). This Agreement is legally binding between you (“User”, “you” or “your”) and Oceanic Escapes PTE LTD (“Oceanic Escapes PTE LTD”, “we”, “us” or “our”).

If you are entering into this agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this agreement, in which case the terms “User”, “you” or “your” shall refer to such entity. If you do not have such authority, or if you do not agree with the terms of this agreement, you must not accept this agreement and may not access and use the Website and Services.

For clarification purposes, the term “Yacht” will, in this agreement, refer to a “yacht available for charter, the yacht owner, yacht management or relevant party representing the yacht” you have indicated an interest in.

By accessing and using the Website and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. You acknowledge that this Agreement is a contract between you and Oceanic Escapes PTE LTD, even though it is electronic and is not physically signed by you, and it governs your use of the Website and Services.

Reservations, Charter Agreement and Payments

The Yacht will provide its Charter Agreement and the corresponding terms & conditions relevant to your reservation/booking, which will be made available to you prior to any request for payment. We are not a party to the reservation or booking agreement and are indemnified against any claims arising from that agreement.

Your reservation and subsequent booking obligate you to settle all fees or charges accrued to your account in accordance with the prevailing fees, charges, and billing terms at the time the respective fee or charge becomes due and payable to the relevant party. Please note that we do not hold, carry, or have access to these funds, as they are paid directly to the Yacht.

Should we deem your purchase to constitute a high-risk transaction, we reserve the right to request a copy of your valid government-issued photo identification, and possibly a recent bank statement for the credit or debit card utilized for the transaction. We retain the discretion to alter product offerings and pricing at our discretion. Additionally, we reserve the prerogative to decline any orders submitted to us. We may, at our sole discretion, impose limitations on or cancel quantities purchased per individual, household, or order. Such restrictions may encompass orders placed through the same customer account, credit card, and/or those utilizing identical billing and/or shipping addresses. In the event of a booking alteration or cancellation, we may endeavor to inform you by contacting the email address and/or billing address/phone number provided at the time of order placement.

Governing Law and Jurisdiction

These terms and conditions are governed by the laws of Singapore, and any disputes arising out of or in connection with these terms and conditions will be subject to the exclusive jurisdiction of the courts of Singapore.

Disclaimer of Liability & Indemnification

User understands that Yacht(s) are considered third-party to Oceanic Escapes PTE LTD. While we endeavor to provide independent assistance to the user, it’s important to note that we are not a party to any Yacht Charter Agreement the user signs or agrees to, thereby absolving us of any responsibility therein. Specifically, we cannot be held liable for any loss, damage, injury, or death resulting from the usage of the yacht, including all aspects of the yacht charter experience, such as (under-)water activities, food & beverage, excursions, and more, as described in the charter agreement. 

To the fullest extent permitted by applicable law, in no event will Oceanic Escapes PTE LTD, its affiliates, directors, officers, employees, agents, suppliers, or licensors be liable to any person for any indirect, incidental, special, punitive, cover, or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use of content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence, or otherwise, even if the liable party has been advised as to the possibility of such damages or could have foreseen such damages.

To the maximum extent permitted by applicable law, the aggregate liability of Oceanic Escapes PTE LTD and its affiliates, officers, employees, agents, suppliers, and licensors relating to the services will be limited to an amount not greater than one dollar or any amounts actually paid in cash by you to Oceanic Escapes PTE LTD for the prior one-month period prior to the first event or occurrence giving rise to such liability. The limitations and exclusions also apply if this remedy does not fully compensate you for any losses or fails of its essential purpose. You agree to indemnify and hold Oceanic Escapes PTE LTD and its affiliates, directors, officers, employees, agents, suppliers, and licensors harmless from and against any liabilities, losses, damages, or costs, including reasonable attorneys’ fees, incurred in connection with or arising from any third party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your Content, your use of the Website and Services, or any willful misconduct on your part.

Accuracy of the Website

Oceanic Escapes PTE LTD diligently endeavors to ensure the accuracy of information presented on the website. Nonetheless, occasional instances may arise wherein the website may inadvertently contain typographical errors, inaccuracies, or omissions concerning product descriptions, pricing, availability, promotions, and offers.
